Privacy statement

1. General

The protection and security of personal data is a top priority for MT-Solutions SA (hereinafter “MTS”). We are committed to open and transparent data processing. This data protection declaration informs you about the nature, extent and purpose of the personal data we process. It also informs you of your rights.

Personal data is information relating to an identified or identifiable natural person (“data subject”). Data processing means any operation performed on personal data, with or without the aid of automated processes, such as collection, recording, storage, modification, consultation, use, communication by transmission, dissemination or any other form of provision, or erasure.

2. Name and address of data controller

The person responsible is the natural or legal person who determines the purposes and means of processing personal data.

3. Categories of personal data

MTS may process the following categories of personal data. We do not process more personal data than necessary.

- Basic and inventory data (e.g. surname, first name, address, date of birth, gender, telephone number, contractual data, information on concluded transactions, bank details)

- Marketing data (e.g. needs, wishes, preferences)

- Technical data (e.g. internal and external identifiers, business numbers, IP addresses, access logs, e-mail addresses)

4. Retention period

The retention period for personal data is determined by legal retention obligations (depending on the applicable legal basis, these are five, ten or more years) or by the purpose of the data processing in question.

5. Purpose of data processing

We may process the personal data described in point 3 for the performance of our own services as well as for our own purposes or those required by law. By this we mean in particular the execution and processing of contracts or services, planning, marketing, market research, comprehensive follow-up, advice and information on the range of services on offer, the preparation and provision of tailor-made services, legal or regulatory obligations to provide information or to notify courts and authorities, and the execution of injunctions issued by the authorities.

6. Legal basis for data processing

Data processing is lawful to the extent that it is necessary for the performance of a contract to which the data subject is a party, or for the performance of pre-contractual measures taken at the request of the data subject. This is the case, for example, for processing operations necessary for the delivery of goods or the provision of another service or consideration. The same applies to processing operations necessary for the execution of pre-contractual measures, for example in the case of requests concerning our products or services. Insofar as we process personal data for the purposes mentioned in this paragraph, we invoke these grounds as justification.

Data processing is also legitimate if the data subject has given his or her consent to the data being processed, or if the processing is necessary to fulfil a legal obligation to which we are subject. Data processing is also lawful if it is necessary to safeguard the legitimate interests of MTS or a third party, which may be the case, for example, if the data subject is one of our customers. Furthermore, data processing is legitimate when the vital interests of a natural person must be protected or when processing is necessary for the performance of a task in the public interest.

7. Data security

The personal data you make available to us is secured by technical and organizational security measures designed to make it inaccessible to unauthorized third parties. We are constantly adapting and improving these security measures in line with technological and organizational developments.

8. Disclosure of personal data

We will not sell, share or otherwise distribute your personal data to third parties, except in situations as described in this privacy statement.

Your personal data may be passed on to third parties who act for us or on our behalf to process the data in accordance with the purposes for which the data was originally collected or for other legally authorized purposes. Such third parties are contractually bound to us to use personal data only for the agreed purposes, not to sell it and not to disclose it to other parties. We reserve the right to do so if required by law, if expressly authorized by us or if described in this privacy statement.

Personal data may also be disclosed to third parties if we are obliged to do so by law, court order, official regulation, in the event of criminal or legal investigations and for any other investigations or legal proceedings at national or international level.

We may transfer, store and process your personal data at data sites around the world, for example where our third-party suppliers or partners are located. In accordance with current legislation, where necessary for the data processing described in this privacy statement, we may transfer your personal data outside the European Economic Area (EEA).

Where data is transferred to countries that do not provide an adequate level of protection, we ensure that data protection is adequate by taking appropriate safeguards, such as contractual safeguards (e.g. based on EU standard clauses; binding corporate rules; your explicit consent for the conclusion or performance of a contract with you, and finally for any relationship such as the establishment, exercise or defense of legal claims.

9. Rights of the data subject

You may ask us to inform you whether your personal data is being processed. If this is the case, we will inform you of the personal data we hold about you. This includes information on the origin of the data, the purpose and, where applicable, the legal basis of the processing, as well as the categories of personal data processed, the persons involved in the collection and the recipients of the data. You also have the right to rectification, the right to erasure of personal data (the right to be forgotten, provided there is no other retention obligation or other legal basis for processing), the right to restriction of processing, the right to data portability and the right to revocation of consent under data protection legislation.

We will be happy to answer your inquiries and any other requests you may have concerning data protection (see point 2).

10. Recording of data when visiting this website

When you visit the www.mt-solutions.ch website, the web server automatically records log files which cannot be attributed to any specific person. This data includes, for example, the browser type and version, the operating system used, the referring URL (the page previously visited), the IP address of the requesting computer, the date and time of access to the server's request and the client's file request (file name and URL). This data is collected for statistical analysis purposes only. It is not passed on to third parties, either for commercial or non-commercial purposes.

11. Newsletter

The newsletter enables us to send you our latest information and offers.

If you wish to receive the newsletter, we require a valid e-mail address as well as certain information that enables us to verify that you are the owner of the e-mail address indicated, or that its owner agrees to receive the newsletter. No other data is collected. This data is only used to send the newsletter and is not passed on to third parties.

When you register for the newsletter, we record your IP address and the date of registration. This storage only serves as evidence in the event of a third party abusing an e-mail address by registering to receive the newsletter without the authorized person's knowledge.

You may revoke your consent at any time, whether to the storage of data, the e-mail address or its use for sending the newsletter. You can revoke your consent via a link directly in the newsletter itself or by communication
(see point 2).

12. Cookies

On our website, we use so-called “session cookies” to make it easier for you to use our web pages. These are small text files which are stored on your hard disk only for the duration of your visit to our website and which, depending on your browser settings, are deleted when you leave it. These cookies do not retrieve any information about you stored on your hard disk and do not affect your PC or its files. Most browsers are configured to accept cookies automatically. However, you can disable cookies or set your browser to notify you when you receive a cookie.

13. Note on Google Analytics

The www.mt-solutions.ch website uses the Google Analytics service, which is operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The cookies used by Google Analytics are stored on your computer and enable analysis of your use of the website.

We use Google Analytics on the basis of our legitimate interests to analyze and regularly improve our website, as well as to regularly improve our offer thanks to the statistics obtained. This is to make it more interesting for you. The use of Google Analytics is also based on your consent to the tracking of your browsing behavior on our web pages and its analytical evaluation.

The information generated by the cookie about your use of this website is generally transferred to a Google server in the USA and stored there. These cookies may contain, for example, the following information: IP address, number of visits, date and time of visit, duration of visit, your access page from which you use the website (referring URL), pages visited on our website, browser type/version and operating system used. 15. Right of recourse to a supervisory authority

This is the case if you believe that the processing of your personal data infringes applicable data protection provisions.
